This website is operated by DiscusDVD. Throughout the site, the terms “we”, “us” and “our” refer to DiscusDVD. DiscusDVD offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

These terms and conditions apply to the use of our website and by visiting our site and/or purchasing products from us you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms, conditions and policies referenced herein and/or available by hyperlink.

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to be bound by all the terms and conditions of this agreement, then you may not access the website, use any services or purchase products from us.

These Terms Of Service apply to all users of the site including without limitation users who are registered members, guests, browsers, vendors, customers, merchants, and/or contributors of content.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page.

We reserve the right to update, change or replace any part of these Terms Of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc. They provide us with the online ecommerce platform that allows us to sell our products and services to you.

General Conditions

By agreeing to these Terms of Service, you represent that you are at least 18 years of age.

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You agree not to reproduce, duplicate, copy or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

You must not transmit any worms, trojans, viruses or any code of a destructive or malicious nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right to refuse service to anyone for any reason at any time.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Linking To Our Site

You may provide links to our website provided you do so in a way that is fair, legal and does not damage our reputation or business.

You may not provide links which suggest any form of association, approval or endorsement on our part where none actually exists.

The website from which you are providing the link must comply with the standards outlined above and we reserve the right to withdraw linking permission without notice.

Your Status

When contacting us by email, telephone, postal mail, social media, website request/enquiry forms or any other avenue of communication you confirm that you are over 18 years of age and agree not to impersonate any other person or use a false name or identity you are not authorised to use.

When accessing our website, browsing, purchasing items from us or placing orders with us you confirm that you are over 18 years of age and agree not to impersonate any other person or use a false name or identity you are not authorised to use.

Your Account

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store.

You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks and (b) changes to conform and adapt to technical requirements of connecting networks or devices.

Credit card information is always encrypted during transfer over networks.

Orders

Any orders placed through the website are only deemed valid by us if you have agreed to our terms and conditions and privacy policy. The tick box appears in your shopping cart and allows you to checkout once ticked.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email provided at the time the order was made although we are under no obligation to do so.

We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, distributors and/or known or suspected fraudulent purchasers and/or addressees.

Products

All of the items we sell were at one time, when in print, available to purchase in high street stores and/or online at ecommerce websites.

The site uses our images of DVD sleeves, cases, discs and packaging.

We show the images so that any potential purchaser can view the disc, packaging, artwork and text. These images may occasionally feature content which some users may find offensive or disturbing. We politely request that you discontinue using our website if you are offended or disturbed by any images or text posted on it.

All DVD content has been passed for retail sale by the BBFC (British Board Of Film Classification) and is certified for viewing under the following ratings:

Uc - Universal Children (particularly suitable for young children), U - Universal (suitable for all), PG - Parental Guidance (general viewing but some scenes may be unsuitable for young children), 12 - Suitable only for persons of 12 years and over, 15 - Suitable only for persons of 15 years and over, 18 - Suitable only for persons of 18 years and over.

DVDs may have the marking E - Exempt (exempt from classification - this may include, for instance, music, sport or educational content).

We do not list or offer for sale any unrated or adult material which has not been cleared and certified by the BBFC as suitable for retail sale.

We provide the above BBFC ratings for your information only.

DiscusDVD has no responsibility whatsoever for the items you choose to order, the content of the discs, any offence or disturbance the disc content or packaging may cause, who you choose to watch the content with or who you allow you view the content.

The items we sell are all genuine UK retail release collectables and are as pictured on the website. We do not sell counterfeit copies, far eastern imports, unreleased material or other illegal items. We provide quality products for our customers. The items we sell are in used very good condition.

All items offered for sale are sold strictly on a second hand collectable basis which is fully compliant with current UK exhaustion of rights law.

Prices

All prices shown on our website are in £GBP Pounds Sterling.

We reserve the right to amend our pricing, without notice, however and whenever we deem it suitable.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

Shipping

Postage within the UK, Guernsey or Jersey is free of charge.

Optional UK express delivery is available at £6.99 per item.

If opting for express delivery we will make every effort to dispatch it on the same business day. However, sometimes, due to the time of purchase or other factors this may not be possible and we may have to dispatch it on the next business day. If same day dispatch is essential to you we suggest contacting us to confirm if we can fulfil same day dispatch for the item before purchase.

Postage within Europe is £6.99 per item.

Postage outside Europe is £9.99 per item.

No overseas items will be dispatched until all applicable postal charges have been paid.

In the event of items returned to us as uncollected, undeliverable, not called for, incorrectly addressed or any other similar reason where we determine the reason for the return is the fault of the purchaser and/or addressee, we reserve the right to bill you, via Paypal, for an additional postal charge, equal to the amount you originally paid for postage, to meet the costs of resending the item to you should you wish it to be resent.

This includes UK delivery where the original purchase included free postage. Resending items where the original postage was free will be billed via Paypal at a rate of £2.99 per item.

If you instead opt for a refund, the amount refunded will be the purchase price of the item only. Any postage paid for items returned to us as uncollected, undeliverable, not called for, incorrectly addressed or any other similar reason where we determine the reason for the return is the fault of the purchaser and/or addressee will not be refunded. This also includes UK purchased items but since the postage was free to the customer (UK postal costs are paid at our expense) we reserve the right to deduct £2.99 from your refund to cover our needless postal expenses.

Extra Charges For Overseas Buyers

DiscusDVD is a UK based non-VAT registered small business.

No UK VAT (Value Added Tax) is charged on your purchase and therefore no VAT is reclaimable.

You understand that, when dispatching orders to countries outside the UK, we are required by law to complete a customs declaration stating description of contents, weight and value of the package.

You understand and agree that we will not, under any circumstances, falsify this declaration with regards to either description, weight or value.

You understand that sales outside the UK may be subject to extra charges including your local VAT - also known as Goods And Services Tax or Sales Tax, Import Duty and Handling Fees. (Admin charges for collecting tax and duty).

Following Brexit - the United Kingdom leaving the EU - this now includes all member states of the European Union.

The extra charges for importing goods from overseas vary in different territories and we would advise any overseas buyers to research prior to purchase. It is your responsibility to calculate the costs of importing goods into your country from overseas should you wish to do so.

You understand and agree that as the importer of the goods, you will be solely liable to pay any of the above charges should they be levied. These are usually charged before release of your package or as you collect the package.

If extra charges are levied and you refuse to pay them your item will not be released by the courier and will either be disposed of or returned to sender.

In the event of disposal of the item we will not be liable to compensate you or refund you any of the cost of the item or the postage you paid in the transaction.

If the item is returned back to us, provided the item received back is as sent, undamaged in any way and in a resellable condition we will refund you the price you paid for the item but we will not refund you any postage paid. A refund will only be paid when the item is confirmed, by us, as delivered back to us, received back as sent, undamaged in any way and in a resellable condition.

In the event that the goods are delivered to you and you are then subsequently billed for extra charges, and you refuse to pay them, DiscusDVD has no liability whatsoever in relation to the charges levied.

Overseas buyers must understand and agree to the above before making purchases at our store.

Customers In The United States And Canada

Customers in the United States and Canada should note that UK PAL DVDs may not play in your territories.

The DVDs we sell are on the UK PAL TV system (625 lines 50 Hz)

This is incompatible with your NTSC TV system (525 lines 60 Hz)

PAL DVDs marked as Region ALL will only play if your DVD player can output a PAL TV signal and your television can display a PAL TV signal.

Many US and Canadian players / televisions do not allow this.

PAL DVDs not marked as Region ALL will only play in specially modified multi-region players. They will not play in standard US and Canadian machines even if these players can output a PAL TV signal.

For these reasons we do not allow shipping of PAL DVDs to US and Canadian customers until we hear from you regarding the above.

Please note occasionally UK DVDs are encoded in NTSC. If they are Region ALL we allow US and Canadian shipping without prior contact since they are fully compatible with US and Canadian hardware.

If you wish to buy an item and are certain you can play it please contact us stating the title and confirming you own the necessary hardware. We will then amend the listing so that you may purchase it.

If you are unsure we recommend against making a purchase since you may have to return it via trackable postage at your expense and your original postage payment will be non-refundable.

Payments

We accept payment by all major credit/debit cards via Shopify Payments, Apple Pay, Google Pay, Shop Pay or Paypal.

All financial details are securely processed via Shopify Payments or Paypal. Making your payment via credit/debit card does not require you to hold or open a Shopify Payments or Paypal account. By making an electronic payment to us you agree to Shopify Payments or Paypal securely processing the transaction.

We accept no responsibility for any charges you incur by your card issuer or bank as a result of processing your payment in accordance with your order (For example, if your purchase causes your account to breach its credit limit or go overdrawn etc).

You understand and agree that if an item is incorrectly priced, either through human error or system failure we reserve the right to cancel the transaction and refund any payments made to us.

You understand that for all purchases outside the UK we can only accept payment by credit/debit card via Shopify Payments, Apple Pay, Google Pay, Shop Pay or Paypal.

If you are a UK resident we will also accept payment via cheque or crossed postal order.

You understand that if you wish to pay via these methods you will need to contact us first so that we can arrange it with you.

When making a payment to us to supply you with goods you agree to disclose basic personal information which we will require to complete the transaction.

You confirm that when making such payments to us that you are over 18 years of age and that the personal details you supply are correct and accurate.

These details will include your full name (first name and surname), your full home or work address including postcode and country of residence, email address and credit card information.

If you require your item to be delivered to an address different to your billing address then these name and address details must be selected at the point you make payment.

If you require your item to be delivered to a third party address then these name and address details must be selected at the point you make payment. By selecting delivery to a third party you confirm the addressee is over 18 years of age.

You agree that if you wish to change the delivery details after you have made payment then the original payment will need to be cancelled, your delivery details amended and your payment resubmitted. You understand that we will only deliver to the address details shown on your payment.

Dispatch

All in stock items will be dispatched within 1 business day of your cleared payment to us. No items will be dispatched until payments have cleared.

If any part of your payment details are vague, ambiguous, incorrect or incomplete we reserve the right to contact you for clarification. In these instances we will only dispatch once we hear back from you.

We dispatch only via trackable services. We will not send an item untracked under any circumstances. We will not deliver to an address where, in our sole judgment, we suspect tracking will not or may not prove delivery.

For UK orders we use Royal Mail Signed For as a minimum. We may use more secure options depending on the item/items purchased, value, delivery location and other factors but this will be at our discretion only. All UK express delivery orders will be sent by Royal Mail Special Delivery.

For overseas orders we use either Royal Mail International Signed or Royal Mail International Tracked as a minimum. We may use more secure options depending on the item/items purchased, value, delivery location and other factors but this will be at our discretion only.

Please note we cannot dispatch orders on Sundays or Public Holidays since there are no post office counter services operating in the UK on those days.

Delivery

Most UK orders should be delivered or have had a delivery attempt within 2-4 business days after dispatch.

Most European orders should be delivered or have had a delivery attempt within 2-11 business days after dispatch.

Most orders from outside Europe should be delivered or have had a delivery attempt within 3-17 business days after dispatch.

Delivery times within these date ranges will vary from country to country. For instance, delivery to France will usually be faster than delivery to Cyprus even though both are in Europe.

These are delivery estimates and we cannot guarantee delivery time especially for overseas purchases which could be delayed due to any COVID-19 restrictions, customs delays, transport failure or other factors outside our control. If you live in a remote area overseas please allow at least 28 days for delivery.

You should allow extra time for delivery in December as the mailing system can be congested due to backlogs caused in the run up to the Christmas period.

If nobody is present at your address and delivery is not possible your item will be securely held at your local sorting office awaiting contact from you to arrange redelivery or collection.

You will be notified of this via a completed card from the delivery company.

You understand that in this event the delivery company will only hold your item for a short time, usually 10-14 days, before returning it to us and therefore swift action is recommended to rearrange collection or delivery of the item.

You understand that when delivery is made to your selected address that the person taking delivery of and/or signing for the item is either yourself or somebody assumed to be acting on your behalf and that when delivery has been proven to your selected address the item is considered delivered to you.

If you cannot vouch for the trustworthiness of any individual who may be present at your selected delivery address then that address should not be chosen as your point of delivery. We take no responsibility for any third party taking delivery of and/or signing for your item at your address. All such third parties are assumed to be acting on your behalf.

In the unlikely event that your package has been visibly badly damaged at the point of delivery you should refuse delivery of the item, request that it is returned to sender and inform us immediately.

Cancellation

In accordance with Consumer Contract Law (June 2014), under Distance Contracts you have the right to cancel your purchase, without giving a reason, within 14 days.

Before dispatch of your purchase - If you wish to cancel you must notify us in writing whereupon your payment will be refunded in full as soon as possible.

After dispatch of your purchase – If you wish to cancel you must notify us in writing within 14 days of delivery. Your payment will be refunded in full once we receive the item back from you but you are liable to pay the return trackable postal cost of the item.

In both cases we will reply back confirming your cancellation. You may, if you wish, also complete our Cancellation Form, although this is optional.

DVD Alerts

If an item you wish to purchase is marked as 'Sold Out' we expect to have it back in stock within 28 days.

Rarer items may take longer to restock and a few extremely rare releases may take several weeks to source.

If you would like a DVD Alert please contact us and we will let you know when your DVD is back in stock.

You may then purchase the item by following the link in our email.

The selling price will be the price shown on the website at the time you made the DVD Alert request provided that we receive stock within 28 days. If we receive stock later than 28 days from your request, and market forces have significantly changed, we reserve the right to amend our pricing to reflect these changes.

All items are dispatched within 1 business day of receiving cleared payment.

Our DVD Alert service is available primarily for collectors to purchase the next available stock once it arrives with us.

You may contact us to cancel your DVD Alert request at any time if you have changed your mind or are not satisfied with the service.

The DVD Alert service we provide is not automated. It requires us to keep records of requests and manually email customers as their stock arrives with us.

Whilst you are under no obligation to buy we reserve the right to withdraw the service from any person we feel is misusing it. This would include, for instance, multiple alerts requested from the same person with no intention to buy or a history of alerts requested with no purchases made etc.

Returns And Refunds

We wish you to be completely satisfied with your purchase. If you are unhappy with your item for any reason we provide a money back guarantee on return of the item.

Returns are accepted for up to 14 days from delivery for a full refund.

Should you wish to return an item please contact us to arrange.

Our returns procedure will vary depending on the location, weight and value of the item.

All returns must be authorised via contact with us prior to returning your item.

We will not accept liability for returned items lost in transit if you have failed to contact us to arrange a return authorisation.

The item should be returned in the same condition as sent via trackable mail. You agree to bear the cost of returning the item unless faulty.

You understand that under no circumstances should items be deliberately damaged and/or made faulty in order to secure free return postage.

All returns must be adequately packaged to prevent damage in transit.

Returns from outside the UK must be clearly marked 'Returned Goods NCV' under the value marked on the customs declaration and include our packing slip or a clear photocopy of our packing skip in the package.

If you no longer have the packing slip please contact us and we will email you another copy which you will need to print and include in your return.

Refunds will be processed once your item has been safely returned to us.

If the item you receive is faulty it is your right under the Sales Of Goods Act 1979 to receive either a replacement, if available, or a full refund on return of the item. In this instance please follow the returns guidelines above. Once we have the item back from you we will either refund you in full or send your replacement.

On receiving your return we will examine it, and, on confirmation of the fault, we will also pay your return postal cost.

Please note that DVDs which do not play due to region and/or TV system incompatibility will not be considered faulty but as bought in error. In these cases, if a refund is required, the purchaser must bear the cost of returning the items via trackable postage and your original postage payment will be non-refundable.

There are numerous and adequate notices regarding region compatibility throughout the website so please ensure you are able to play any purchases which you make. It is your responsibility to ensure that you own the necessary hardware required to play your purchase in your area.

You understand that under no circumstances will we issue partial refunds nor issue full refunds without first receiving our goods back.

All goods returned to us must be in the same condition as sent. They must be exactly the same product as sent and include all discs, cases, sleeves and paperwork.

You understand that if you return a substitute product, a counterfeit product, a deliberately damaged product, a modified product, an incomplete product or an item different to the one we sent to you then we will consider this a fraudulent act and notify the relevant authorities. We will not tolerate customer fraud and will always act on any such attempts.

Personal Information

DiscusDVD is committed to keeping your personal information secure.

Online purchasing requires you to disclose basic personal information, for instance, your name, home or work address and email details.

These contact details are used to process your transactions on our website.

We do not send out advertising or marketing via post, SMS text or phone calls. We may answer your enquiries by these methods if these are the means by which you have contacted us although we prefer contact via email.

We may email you with news or exclusive offers but only if you have subscribed to receive these emails at the bottom of the webpage or ticked the ‘keep me up to date’ box at checkout.

Subscribing to our marketing requires verification by clicking a link in the marketing confirmation email we will send you. We will not recognise you as a subscriber unless you have verified using the process above.

You may unsubscribe from our marketing at any time by clicking on the unsubscribe link at the bottom of our marketing emails.

Otherwise we will only contact you via email regarding your purchases, messages or enquiries with us.

We keep a record of your emails and we may contact you some time after your initial enquiry to inform you that the item you were seeking has arrived in stock.

All financial details are processed securely via Shopify Payments or Paypal.

Our website is certified Level 1 PCI DSS compliant and operates securely via 256 bit Secure Sockets Layer protocol (SSL) - the highest level of encryption commercially available.

Your submission of personal information through the store is governed by our Privacy Policy.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

You understand that if you choose to access our website via a VPN (virtual private network) which disguises your true IP address and geographical location then certain operational features of the website may not work correctly. You agree that we are not liable or responsible for any issues, malfunctions or interruptions of service should you choose to access the site via a VPN internet connection.

Using a VPN (virtual private network) may cause you to override our region compatibility measures. If your true geographical location is disguised this may allow you to purchase DVDs which are not compatible to play in your territory. In these instances we will contact the buyer to ensure the necessary multi-region hardware is owned. We will not dispatch any items until we hear back from the buyer confirming the correct hardware is owned to allow playback of the item purchased.

In no case shall DiscusDVD, our director, contractors, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Indemnification

Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Termination

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
